Truck driver put out-of-service for beer in the cab

The California Highway Patrol (CHP) recently put a truck driver out-of-service after discovering empty beer bottles and unopened bottles of beer in the cab during a routine inspection on March 20.

What happened: While checking for an overweight violation, CHP inspectors heard the clinking of glass inside the truck. Further investigation revealed four empty bottles and three unopened bottles of beer in the vehicle.

  • The driver wasn’t under the influence of alcohol but was found in violation of possessing alcohol in a commercial vehicle.
  • As a result, the driver was placed out-of-service for 24 hours under 49 CFR 392.5.

The regulation: According to the eCFR, drivers are prohibited from being on duty or operating a commercial vehicle with alcohol inside, unless it is part of a shipment.

CHP took to social media to emphasize the rules regarding alcoholic beverages in commercial vehicles. Thankfully, no further issues arose from this incident.
