Truck driver fired after skirt dispute sparks religious rights lawsuit

CEMEX Construction Materials Florida is in legal trouble after firing a female truck driver who asked to wear a skirt for religious reasons.

The details: The truck driver is an Apostolic Christian. She asked CEMEX if she could wear a close-fitting skirt over her work pants, saying it was part of her religious practice.

  • The company refused her request, pointing to its policy not allowing loose clothing.
  • The driver was following policy by wearing a close skirt over pants. Still, she was told she must pick between the skirt or her job.
  • She chose to keep wearing the skirt. CEMEX then let her go.

EEOC action: The U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit, saying the company broke federal law that protects workers’ rights to religious accommodation. “Employers must not make their employees choose between observing their religion and maintaining their livelihoods where, as here, there is no undue hardship to the company,” said Tamra Schweiberger with the EEOC.

The lawsuit was officially filed in federal court after the EEOC tried to settle the matter before going to trial, according to an EEOC press release.

As of now, the case is still ongoing in court.
