Open marijuana container leads to 24-hour out-of-service order

A truck driver was pulled over by the California Highway Patrol in Santa Clara County on June 4 after driving a commercial vehicle on Monterey Road where big rigs over 7 tons are not allowed.

What happened: The trooper said they could smell marijuana inside the cab once the driver was stopped. A search turned up an open container with marijuana.

  • The driver was given a ticket for having an open container of marijuana in the cab.
  • CHP ordered the trucker out of service for 24 hours, following the Commercial Vehicle Safety Alliance’s out-of-service criteria which prohibits drivers from operating if they have drugs or substances that could affect safe driving, according to CVSA.

After 24 hours, the driver will be able to return to work once the out-of-service period is done.
